      This sucks, for all of us - but since we are our own police, this kind of thread is a necessary evil. The dark side of the hobby. So far, I have seen a lot of really good energy and this only inspires redistribution of good energy, so let us all reinforce our integrity by this example and not let this happen again. I am really close to suggesting that this seller get put on the Black List...

            Yes I am back on the Job.
            After reading the first sales post and thread carfully I have to point out what I have learned in 10 years of ebay and trading online. If a service in not listed it is not included. As a buyer you sould never make the assumption that a service is included because a shipping charge is high enough to cover it.

            That being said.....

            Now we fall into a grey area due to the lack of an "as is where is" statment. Meaning the sale of the item is final in the current condition upon delivery. Hydro.. with out that statment you are under contract to deliver this item in the condition in which it apears in the pictures you posted. There for not including the as where is means you should have insured this item to preserve that current state.

            In conclusion you may not be legaly bound by international law to refund this sellers money.

            If you wish to sell items on this forum in the future you will. It's my opinion the the proper care was not taken to protect this item. By not refunding some or all of this buyers money allowing any more items to be listed on the forum by you is not in the best interests of the forum members and it's owner.

              1. You stated the box arrived crushed, in your first P.M. to me. If the boat was not packed correctly this would mean the boat was damaged but not the box. This is not the case.

              2. The package has been mishandled somewhere in transit.

              3 You fail to mention how the boat was packed. That bubble wrap shown in the photo, is only from around the sponsons. There was pink bubblewrap wrapped around the boat. There was also grey foam. packing blocks placed around the boat, aswell as the paper for the corners. The box was clearly labelled with with proper stickers "FRAGILE" in more than one spot.

              4. I had to show the parcel to my post office for customs before closing it and there is NO WAY Australia Post will allow anything to be sent unsecured. It is against their policy. They seal it, not me.

              5. You didnt ask for insurance. I did have it registered and all the numbers needed are on the paper on the front of the box, in the plastic satchel.

              6. I have tried to be helpful, i sent the boat off promptly, it was packed correctly, I enquired what you are to do with the problem at my post office.

              7. You are obviously claiming for damaged goods from you post office, so i don't understand what i should be re-emburrsing you for. You will be re-emburrsed from your postal service. Unless i hand delivered this pakage to you, it is out of my hands in the post.

              8. To the Moderator, how can you allow for someone to threaten others with no re-course for his action, not a word mentioned.

              9. Let the this be a warning to anyone else selling their boats DO NOT DO IT WITHOUT INSURANCE!!!

                Well you and I see things quite differently Hydro. I did not ask for insurance I was only asking if you had put insurance on it as a clarification it was not an expectation. I do not agree with you that it was packed properly so we will have to agree to dissagree. There were only the two pieces of pink bubble wrap in the box because I saved all the contents knowing it would be evidence for the claim. The grey foam you refer to was underneath the boat . There was very little of it. everything was very loose in the box when I opened it.

                I personally ship things knowing that what ever service it is shipped though will ineveitably damage the box so I build in a saftey factor or crush zone. again you and I have very differnet opinions of how things should be done.

                I work in a manufacturing bussiness and ship everything I make. I am responsible for those items to get to my customers in good shape. If the companies I contracted with mess up I still have the responseability to get them the goods they paid for in a timely manner and I would have to seek compensation for the contracted carrier for damaged goods not my client. that is why I have a completely different view then you. I would love to say "Oh I shipped it properly and you just have to take it up with cargo company X so sorry. again I think we are from different worlds.

                have recived 6 boats from sellers off of this forum and others and they all have arived in perfect condition. and boxed very well. many boxes have been damaged and nothing damaged on the boats. again we see things differently.

                I paid for a boat I belived "in good faith" would be delivered to me where all I would have to do to it was drop in my radio gear, speed control, my servo and batteries and be off to the pond because that is what you were selling. The more I think about this the more torked I get. I don't take to kindly to getting screwed and I have not threatend you in any way. It is unprodutive and will not solve this problem.

                My time is valuable and I have very little free time so I didn't buy all new parts because of limited time to build. The post office said it would be weeks before anything would be decided. I don't want to build an new hydro but I would settle for a refund of $84.99USD so i can get a hull to replace the damaged one. Or you could refund all my money and I can ship this one back to you so you can do what ever you want with it. I stated in the paypal dispute that I would take one of the other hulls less hardware and motor as a repalcement so the choice is up to you.

                I do have the information off of the shipping and did file a complaint with the post office so I apreaciate that help as I have never had to do this before.

                  To recap, The boat had hardware installed when YOU shipped it. It didn't when it was shipped to you in that box. The 2 inch cushion fwd of the sponsons and the 2 inch cushion aft of the transom have now been compromised (due to the HW installed). You should have either removed the HW for shipping, or used a longer box.

                    I agree 100% with this stament.
                    Also another good idea is to have a uniform disclaimer for all listings. I'm sorry you guys are unable to work this out. This hobby is about fun and relaxation, not stress and dissapointment...
