I could see an issue with copyright if somebody was selling the decals for his own profit. I'd kinda be surprised if they went after a modeler building a one off scale copy of their boat and not profiting from it.
I hope there is a slight difference there!
That would be an awful precedent for scale modelers everywhere.

Who is that modeler going to get his scale decals from if he doesn't have access to machines to do it himself? If it is a one off product not meant for distribution it can possibly be considered in the grey area...... Don't want to get in a big debate about it.
It's a difficult subject you can find all sorts of info on if you google it.

if the builder makes the decals themselves for their use, I believe they are in the clear

but to make a profit, that is a no no
