I'm slightly lost in your post. Was the eBay description of the boat wrong or unclear? Or did you know it had some damage and are confused why it has a clear title?

most of the boats I've seen that are insurance salvage don't have any sort of title issues or show up on boat fax.

My boss purchased a trophy 2901 from new York after hurricane sandy. It had most of the stern ripped off and was sitting at the bottom of the marina and it still had nothing on a boat fax. Clean and clear title.

If pics didnt show the damage to the bottom and description didnt say it either you should be covered by ebay................you can most likely get your $ back

You wish. Only the money in the seller's account can be refunded by eBay. If the seller's account is empty, too bad for the buyer. Been there, been hosed.....

If he paid thru paypal they can "hold" the money, just sayin, they usually hold it for 30 days til the buyer is satisfied. Ebay has protection as well, They "accidently" refunded a buyer on a claim and they paid me the money back out of there own $$$. Not sure how cars and boats work, but i'd push them hard............

If you're looking for a way to get a title on a salvaged boat, you will probably have to contact the DMV for the application process
Information, regulations, and DMV resources regarding salvaged vehicles in New York. Find out how to register and rebuild your salvage car.

If you purchased the boat but it "wasn't as described" then your best bet is to go through paypal first, then your credit card company. Both entities have pretty strict rules on "not as described" merchandise.

                  This might help as well.

Also, depending on the amount of the loss, it might be worth retaining a lawyer.

Sorry to hear about the troubles...I hope it works out.
